Out of the net fundraising proceeds, Ohioans for JD shall allocate to the Committees all contributions it receives from sources an in amounts permitted by the Act according to the Agreement and this allocation method:
a) For contributions received from individuals and non-multicandidate committees:
i) JD Vance for Senate Inc. shall receive, for deposit in its general account, the first $2,900 of any single contribution or series of aggregated contributions, designated for the General Election; and then
ii) Ohio Republican Party shall receive, for deposit in its federal account, the next $10,000 of any single contribution or series of aggregated contributions; provided, however, that Ohio Republican Party shall not receive from any single contributor a single contribution or aggregate contributions exceeding $10,000; and then
iii) JD Vance for Senate Inc. shall receive, for deposit in its general account, the next $2,900 of any single contribution or series of aggregated contributions, designated for 2022 Primary Election Debt Retirement; and then
iv) Working for Ohio shall receive, for deposit in its federal account, the final $5,000 of any single contribution or series of aggregated contributions; provided, however, that Working for Ohio shall not receive from any single contributor a single contribution or aggregate contributions exceeding $5,000.
b) For contributions received from multi-candidate committees:
i) JD Vance for Senate Inc. shall receive, for deposit in its general account, the first $5,000 of any single contribution or series of aggregated contributions, designated for the General Election; and then
ii) Ohio Republican Party shall receive, for deposit in its federal account, the next $5,000 of any single contribution or series of aggregated contributions; provided, however, that Ohio Republican Party shall not receive from any single contributor a single contribution or aggregate contributions exceeding $5,000; and then
iii) JD Vance for Senate Inc. shall receive, for deposit in its general account, the next $5,000 any single contribution or series of aggregated contributions, designated for 2022 Primary Election Debt Retirement; and then
iv) Working for Ohio shall receive, for deposit in its federal account, the final $5,000 of any single contribution or series of aggregated contributions; provided, however, that Working for Ohio shall not receive from any single contributor a single contribution or aggregate contributions exceeding $5,000.
2. Ohioans for JD shall return, in its entirety, any contribution received from any corporation, labor union, federal government contractor, foreign national without a green card, or other federally impermissible source.
3. JD Vance for Senate Inc., Working for Ohio or Ohio Republican Party may decline to accept any contribution from any source, the legality of accepting said contribution notwithstanding.
4. The allocation formula may change if Ohioans for JD receives a contribution which exceeds the amount a contributor may give to any participant. Ohioans for JD shall reallocate to the other Committee(s) any contribution or portion of a contribution which, upon allocation in accordance with the Agreement and this formula, would cause the donor to exceed that donor’s contribution limit to any of the Committees.
5. For the purposes of the formula set forth in Paragraph 1, above, “net fundraising proceeds” shall not include cash advances to Ohioans for JD from any Committee. All such advances shall be based on a good faith estimation of the net proceeds made up of contribution allocations to the Committees. 11 CFR § 102.17.
6. Pursuant to 11 CFR § 102.17(c), any donor may designate his or her contribution for a particular Committee. Ohioans for JD shall not reallocate any contribution so designated, which exceeds the contributor’s limit to the designated Committee, without the prior written permission of the contributor as required by 11 CFR § 102.17(c)(6)(ii). Notwithstanding the foregoing, the Committees specifically agree that any contribution which is not so designated shall be distributed pursuant to the allocation formula set forth in Paragraph 1, above, that each Committee’s share of net proceeds is not earmarked for any other particular candidate or use, and that each Committee shall use its share of net proceeds in its sole discretion.
7. In lieu of contributing to Ohioans for JD, any contributor may make his or her contribution payable directly to JD Vance for Senate Inc., Working for Ohio or Ohio Republican Party. If a Committee receives and deposits a contribution in connection with a joint fundraising event, solicitation, or other activity, its treasurer shall inform Ohioans for JD’s Treasurer, who shall take such contribution into account for purposes of allocations and distributions.
